Terms of Use

These Terms of Use ("Terms") govern your use of Acedly (the "App"), provided by 617SW, LLC ("617SW," "we," "us," or "our"). By using the App, you agree to these Terms.

1. Acceptance of Terms

These Terms govern your use of the App. If you do not agree to these Terms, do not use the App. These Terms also serve as the end user license agreement between you and 617SW for the App.

2. License

Subject to these Terms and the applicable app store terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App on a device you own or control, for your own personal, non-commercial exam-preparation purposes.

You may not copy, resell, redistribute, sublicense, rent, lease, reverse engineer, scrape, or attempt to extract the App's question content or source, except to the extent this restriction is prohibited by applicable law.

3. Apple Standard EULA and Google Play Terms

If you download the App from the Apple App Store, your use is also subject to Apple's Standard End User License Agreement unless we provide a separate custom license in App Store Connect. If you download the App from Google Play, your use is also subject to the Google Play Terms of Service. You acknowledge that these Terms are between you and 617SW, not Apple or Google, and that Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.

4. Study Aid Only — No Guarantee

Acedly is an educational study aid. It does not provide legal, financial, or professional advice, and it is not a substitute for official exam materials or the guidance of your state real estate commission. We do not guarantee that using the App will result in passing any exam or obtaining any license. The in-app Accuracy Disclaimer is incorporated into these Terms.

5. Accuracy of Content

Real estate laws and regulations vary by state and change frequently, and content — especially state-specific material — may be incomplete, inaccurate, or outdated. State modules are reviewed against publicly available materials from the relevant state real estate commission, but that review is not a substitute for the official source. The official candidate handbook and your state real estate commission are always the authoritative source, and you should verify any fact before relying on it.

6. Subscriptions, Purchases, and Billing

Acedly offers auto-renewing subscriptions and may offer one-time purchases such as individual state modules. Prices are shown in the App before you buy.

Auto-renewing subscriptions renew automatically at the end of each billing period unless you cancel at least 24 hours before the period ends, and your account is charged for renewal within 24 hours prior to the end of the current period. You can manage or cancel a subscription in your app store account settings after purchase; deleting the App does not cancel a subscription.

Payments, renewals, and refunds are handled by the app store under its terms. Except where required by law, purchases are non-refundable, and refund requests are subject to the policies of Apple or Google.

7. Responsible Use

You are responsible for using the App lawfully. You agree not to interfere with or disrupt the App, circumvent security or entitlement checks, access the App through unauthorized means, or use the App or its content to build or train a competing product or dataset.

8. Availability and Changes

We may update, modify, suspend, or discontinue features of the App at any time. We are not responsible for interruptions, device limitations, permission limitations, operating system changes, third-party service failures, app store changes, or data loss.

9. Disclaimer

The App and its content are provided "as is" and "as available" without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that the content is accurate, complete, current, or error-free, or that the App will be uninterrupted or secure.

10. Limitation of Liability

To the fullest extent permitted by law, 617SW, LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, incorrect output, or any exam or licensing outcome, arising out of or related to your use of the App. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

11. Governing Law

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-laws rules, except where your local consumer-protection law requires otherwise.

12. Changes and Contact
