Terms of Use

1. Acceptance of Terms
These Terms of Use ("Terms") govern your use of SoftRise (the "App"), provided by 617SW, LLC("617SW," "we," "us," or "our"). By using the App, you agree to these Terms.
2. License
Subject to these Terms and Apple's applicable App Store terms, we grant you a limited, non-exclusive, non-transferable license to use the App for personal, non- commercial relaxation and sleep use.
3. Apple Standard EULA
Unless we provide a separate custom license in App Store Connect, your use of the App is also subject to Apple's Standard End User License Agreement for apps distributed through the App Store.
4. Not Medical Advice
SoftRise is a relaxation and sleep-ambience app for general wellness and comfort. It is not a medical device and does not diagnose, treat, cure, or prevent any condition, including insomnia or any sleep disorder. Do not rely on the App for medical decisions. If you have concerns about your sleep or health, consult a qualified professional.
5. Wake Alarm and Reliability
The wake alarm depends on iOS notifications, your device settings, permissions, battery state, volume, Focus and Do Not Disturb settings, and the App remaining installed. Do not rely on the App as your only alarm for time-critical wake-ups. We are not responsible for missed, delayed, silent, or repeated alarms.
6. Responsible Use
Do not use the App while driving or operating machinery, or in any situation where falling asleep or reduced attention could be unsafe. You are responsible for your volume levels and for using audio safely.
7. Purchases and Subscriptions
Some features require the SoftRise Pro subscription. Purchases are processed by Apple and managed with the help of RevenueCat. Subscription availability, current pricing, any introductory offer, renewal, cancellation, refund handling, and billing are governed by Apple's App Store terms and your Apple account settings. Subscriptions renew automatically until canceled, and you can manage or cancel them in your Apple account.
8. Availability and Changes
We may update, modify, suspend, or discontinue features of the App at any time. We are not responsible for interruptions, device limitations, permission limitations, operating system changes, third-party service failures, app store changes, or data loss.
9. Disclaimer
The App is provided "as is" and "as available" without warranties of any kind, express or implied, to the fullest extent permitted by law.
10. Limitation of Liability
To the fullest extent permitted by law, 617SW, LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, device issues, missed or delayed alarms, or actions you take based on the App.
11. Changes and Contact
We may update these Terms from time to time. If we make material changes, we will update the effective date above. Questions can be sent through our contact form.
