Terms of Use

1. Acceptance

By downloading or using TV Remote for Vizio (the "App"), published by 617SW, LLC("617SW," "we," "us," or "our"), you agree to these Terms. If you do not agree, please do not use the App.

2. What the App Does

The App turns your iPhone into a remote control for compatible Vizio SmartCast televisions on your own Wi-Fi network. It communicates directly with your television using the interfaces the television exposes on your local network.

3. Compatibility Is Not Guaranteed

Vizio televisions differ widely by model, model year, and firmware version. Features that work on one set may be absent, behave differently, or be removed by a firmware update on another. In particular, and without limitation:

• Powering the television on over the network requires its Power Mode to be set to Quick Start. In Eco Mode the television disconnects from the network entirely when off and cannot be reached by any application;
• Typing, the sleep timer, screen-off, and input listings rely on interfaces that not every model or firmware provides;
• Which applications can be launched varies by television and region.

We make no representation that the App will work with any particular television. If it does not work with yours, you may request a refund from Apple.

4. Subscriptions

The App offers optional auto-renewing subscriptions that unlock additional features. Current pricing is shown in the App before purchase.

• Payment is charged to your Apple ID upon confirmation of purchase;
• Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period;
• Your account is charged for renewal within 24 hours of the end of the current period, at the rate then displayed;
• You may manage or cancel a subscription in your Apple ID account settings at any time after purchase;
• Where a free trial is offered, any unused portion is forfeited if you purchase a subscription during the trial period.

Purchases are processed by Apple. Refunds are handled by Apple under its own policies and we cannot issue them directly; requests may be made at reportaproblem.apple.com.

5. Acceptable Use

Use the App only with televisions you own or are authorised to control. Do not attempt to reverse engineer, resell, or redistribute the App except as permitted by law or by Apple's terms.

6. No Warranty

The App is provided "as is," without warranty of any kind, express or implied, including any implied warranty of merchantability or fitness for a particular purpose. We do not warrant that it will be uninterrupted, error free, or compatible with your equipment.

7. Limitation of Liability

To the fullest extent permitted by law, 617SW, LLC is not liable for indirect, incidental, special, or consequential damages arising from use of the App. Our total liability is limited to the amount you paid for the App in the twelve months preceding the claim. Some jurisdictions do not allow these limitations, so they may not apply to you.

9. Governing Law

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-law rules.

10. Changes and Contact

We may update these Terms from time to time. If we make material changes, we will update the effective date above. Questions can be sent through our contact form.
